The question here is why are these builders not executing registries even after obtaining the OC (Occupancy Certificate) & CC (Completion Certificate) from the authorities concerned. The fact is that these smart developers delay & often deny registries to the home buyers to get maintenance of society when it is not registered. They continue to charge hefty amount in the name of society maintenance. Add ot it, revenue that they get from inflated power bills. After the registry of the apartment, majority of apartments buyers are free to form AOA (Apartment Owners’ Association).

Will States going to polls reduce Stamp Duty on property?

When the Union Finance Minister, Nirmala Sitharaman, urged the States to cut Stamp Duty rates in her 2024-25 budget presentation, this was by & large seen as a mere headline making statement. Why would States cut the Stamp Duty on property when it is one of the major sources of revenue, was the general feeling in the collective consciousness. Property re-sale procedure vague and prone to misuse

A homebuyer in Noida wished to sell his newly delivered apartment before the formal registry to the other party. As per the law, there is no transfer charge applicable since the said property has not been registered in the name of the first party itself and stamp duty is yet to be paid. However, he was taken by surprise when the builder asked for Rs. 2 lakh fee in the name of expenses with the Noida Authority.

The builders’ stand is that once the allotment letter is given to the buyers, he has to submit the list to the authority and henceforth there are expenses involved.
