Home buyers demand Force Majeure in accordance with law of natural justice

The good news is that the Indian home buyers do understand that the lockdown post the Coronavirus was neither in the hands of the builders nor could have been anticipated. They hence don’t object to the period of six months being declared to be Force Majeure. The bad news is that the home buyers across the country feel the government’s declaration of Force Majeure is not in accordance with the law of natural justice. Track2Realty Online Poll finds that the home buyers are demanding equal leeway in the housing market.

It is pertinent to note here that there has been nothing posted on Hawelia Facebook page that could be defined as “Defamatory” by the Indian Penal Code (IPC). It seems builder does not believe in the IPC and wants to continue his fiefdom with HPC (Hawelia Penal Code). As per the law of the land, any comment/feedback/grievance could only be termed as defamation if it can’t be substantiated with the fact. Truth stands as biggest defence against the defamation. The chain mail between the builder and the home buyers of Hawelia Valenova Park could establish the fact that the buyers are not happy with the builder and the builder failed to even come forward to address the concerns.

It is in this backdrop that in a typical “Ravi Sinha Uncensored” tone I told a PR girl who called me for one such Press Release by one of the largest developers of Mumbai, “Listen! As a matter of principle I am not carrying any story on food distribution to construction workers. But wait! Please give my feedback to your client, “He or any other builder is not doing any charity; not worth beating its own trumpet. This is a national calamity and you are morally bound to do so. Such Press Releases only make you look really petty. You can weave this info into some other story once the dust settles and everything is normal. But glorifying humanitarian gesture at this point of time is at best Corona Tourism for Publicity which is highly deplorable.”

It is pertinent to note here that the builder has serious tussle with many of the home buyers at both his projects. Many a times the home buyers have been overtly refused the services with point blank justification that the Hawelia Facility Management is not obliged to entertain those who are unsatisfied buyers. However, in today’s pandemic it is not just unprofessional & unethical but also inhuman to not facilitate supply of day-to-day commodities when the builder’s commercial shops are not operational. Interestingly, Hawelia’s CSR initiative is called as Hawelia Humanity.

I&L space take-up in 2019 was dominated by small-sized transactions (less than 50,000 sq. ft.), which held a share of about 42%. The share of medium-sized transactions (ranging between 50,000 sq. ft. and 1,00,000 sq. ft.) rose from 26% in 2018 to 30% in 2019. Large-sized deals (greater than 1,00,000 sq. ft.) accounted for 28% of the leasing activity during 2019. The number of large-sized deal closures in Hyderabad, in particular, doubled in 2019 as compared to 2018.

Despite repeated attempts by Track2Realty, none of the developers with projects in the worst hit areas are ready to speak on camera. All of them are rather defiant that the construction ban is unfortunate disruptions and adversely affects the project timelines. The moot point nevertheless is can the builders in their collective consciousness shrug off the responsibility now? Do they wake up only when the NGT slaps the sector with construction ban? Can’t they switch to responsible urbanisation for future generations?These questions may not bother them but what they can’t afford to ignore is whether or not the housing sector in Delhi NCR would be paralysed if the city is not made worth breathing and worth living?” Unfortunately, there are more questions than what any of the stakeholders would like to answer with some honesty.

South cities’ housing absorption slumps, Pune and MMR race ahead

The three southern cities collectively saw residential sales of 61,400 units between January and September 2019 as against 64,420 units sold in the first three quarters of 2018. MMR and Pune, on the contrary, saw the sale of nearly 93,930 units in 2019 against 70,740 units in the corresponding period in 2018. Altogether, the top 7 cities recorded sales of 2,02,200 units in 2019 till September, of which western cities comprised 46% overall share while southern region consisted of 30% share.

Macro trends in residential may be misleading

First, residential project delay is not a pan-India phenomenon and only limited to major metropolitan cities of Delhi NCR and Mumbai in terms of quantum as well as value of projects. Second, the slowdown in completion of projects is not across the entire spectrum of housing categories but significantly visible in upper-mid and premium categories. What is needed is perhaps a push from the government and funding agencies along with a strict code of conduct among developers which will improve the situation. Going forward, developers should take cognizance of the situation at hand and accordingly realign their marketing strategies so that their launches are in sync with people’s affordability and demand.
